These Terms of Service (“Terms”) govern your use of the Florbloom website (our “Site”) and all services offered by us, including the order, purchase, and delivery of flowers, plants, and gifts across Gurgaon (“Services”).
By accessing our Site or placing an order, you agree to be bound by these Terms, as well as our Privacy Policy and Return & Refund Policy, which are incorporated here in by reference. Please read them carefully.
1. Our Services
Florbloom provides a service to purchase and schedule the delivery of fresh flowers, plants, and related gift items within Gurgaon, Haryana. We reserve the right to refuse service to anyone for any reason at any time.
2. User Eligibility & Obligations
By using our Services, you represent and warrant that:
- You are at least 18 years of age and have the legal capacity to enter into a binding contract.
- You will provide accurate, current, and complete information, including your name, email, phone number, and delivery details.
- You are responsible for providing the correct name, address, and phone number for the intended recipient. Florbloom is not liable for non-delivery or late delivery due to incorrect information.
- You agree not to use our Site or Services for any unlawful purpose.
3. Orders and Acceptance
- Placing an Order:Â When you place an order, you are making an offer to purchase the selected products under these Terms.
- Order Confirmation:Â You will receive an email or message confirming your order. This confirmation does not signify our acceptance of your order; it simply confirms that we have received it.
- Acceptance & Rejection:Â We reserve the right to accept or reject any order in our sole discretion. This may be due to the unavailability of a product, an error in pricing, or issues with payment. We will notify you if your order is canceled.
4. Pricing and Payment
- All prices are listed in Indian Rupees (INR).
- Prices are subject to change without notice. The price charged will be the price in effect at the time your order is placed.
- All applicable taxes, delivery fees, and other charges will be clearly displayed during the checkout process.
- Payment must be made in full at the time of placing the order through our accepted payment gateways (e.g., credit/debit card, UPI, net banking).
5. Delivery Policy
- Delivery Area:Â Our delivery services are limited to addresses within Gurgaon, Haryana.
- Delivery Times:Â
- We will make every reasonable effort to deliver your order on the selected date and within the specified time slot.Â
- For all same day orders, orders have to be made before 9 pm on the same day. All orders made after this shall be considered for delivery latest by the next day.
- However, all delivery times are estimates and cannot be guaranteed (due to traffic, weather, or other unforeseen circumstances).
- If the Recipient is Unavailable:Â If the recipient is not at the delivery address, we will attempt to:
- Call the recipient and/or the sender for instructions.
- Leave the order with a trusted person (e.g., family member, neighbor, building security) if they agree to accept it.
- If no one is available or we are unable to reach you, the order may be returned to our shop. A re-delivery attempt may incur an additional delivery charge.
- Incorrect Address:Â We are not responsible for non-delivery if the address provided is incorrect or incomplete.
6. Product Quality & Substitution Policy
- Product Appearance:Â Flowers and plants are natural products. Their appearance, color, and size may vary slightly from the photos on our website.
- Substitution Policy:Â Due to seasonal availability and market conditions, it may be necessary to substitute a particular flower, plant, or container. We guarantee that any substitution will be of equal or higher value and will maintain the overall style and theme of the arrangement. We will make reasonable efforts to contact you if a major substitution is required.
7. Cancellations, Returns, and Refunds
Our policies regarding cancellations, returns, and refunds are detailed in our separate Return & Refund Policy. Please review it for full details.
- Flowers & Plants:Â Are perishable and cannot be returned. Refunds are only possible for damaged or incorrect items, as specified in the policy.
- Gifts (Non-Perishable):Â Are eligible for both return and refund, subject to the conditions in our policy.
8. Intellectual Property
All content on this Site, including text, graphics, logos, images, and software, is the property of Florbloom or its content suppliers and is protected by Indian and international copyright laws. You may not reproduce, modify, distribute, or use any of our intellectual property without our express written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Florbloom shall not be liable for any indirect, incidental, special, or consequential damages (including loss of profits) arising out of or in connection with our Services, products, or these Terms. Our total liability to you for any and all claims shall not exceed the total amount paid by you for the specific order giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Florbloom and its employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.
11. Changes to These Terms
We reserve the right to modify these Terms of Service at any time. Any changes will be effective immediately upon posting the updated Terms on our Site. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.
